In conclusion: Political history argument in favor of an Article V process and revocation of the 14th, 16th, and 17th Amendments.
The single-most destructive influence that has effected every government that has ever existed on the face of the earth is the imperfection and moral corruptibility of man.
“Our virtues and our failings are inseparable, like force and matter. When they separate, man is no more”. Nikola Tesla
Corruptive influence can makes careers and fortunes, turn representatives and leaders into special-interest peddlers and recipients, whose votes can be had for the highest bid or extreme pressure or bribe. It provides and thrives the environment of lobbyists, and secret deals, and the source for laws and regulations that bondage the citizens; while enriching the elected official* who is their servant, or the government which provides the chair. It happens at every level of government. It is no respecter of persons - when the said representative or issue no longer serves what-ever master, they are replaced by someone who will legislate the desired outcome.
*It should be noted that there are politicians today that do diligent and responsible work for their citizens and their states - they are to be highly commended - for they are indeed rare and in the minority.
We would also like to address the long practice of the media and of persons and personalities that serve to continue and perpetuate the racial divide in this country.
Color, Ethnicity, Gender, Creed- the great controllers of politics and politicians, because those who will use them think we see each other the way they see us. Those who decry the foul are the first to point at the difference. They use prejudice like a poison. Let them not tell us how we see our fellow man, we will no longer let you. We can no longer ignore the feelings of outrage and frustration we have when they lay the match to the tinder and then step way back and shout “fire!” Race is the big gun in their arsenal - they use it in every effort or issue where they are losing the debate. The only racists that should exist in America today are the HUMAN-RACISTS. United may we work together to build the America Dr. Martin Luther King saw in his dream. It is the dream worth sharing. America is ready for this reality if we could just stop the matchmakers. We should all refuse to be used as another voting block in a dirty political game, they prey upon the groups they put us into, may we all shirk off the baits they set - that only serve to reel us in. After every election, when they no longer have the urgent need for our vote, they seem to tend more to their own business than to ours.
If you look at the political history of the Country to date, taking in all the events that have brought us to now….we would like you to consider 3 water-shed and pivotal foundations.
WE compare them best to a space launch…
EARTH
The Founders and the Founding documents: The Declaration of Independence, The Constitution Articles and the Bill of Rights - Amendments 1-10. A Nation that is a Constitutional Republic: a government in which the citizens rule through elected officials - based on a charter, or contract, or drafted Constitution from which all laws are made.
Our journey launches us free of gravity,
In the period between foundation and the first 100+ years:
We see the original documents stand in good service as well as two additional amendments:
11th Amendment - 1794 which protects the states in a lawsuit brought in federal court.
12th Amendment - 1804 which defines the election of president and vice-president as two separate positions and individuals to avoid an electoral tie and a repeat of the election of 1800 between Thomas Jefferson and Aaron Burr. (You will recall that dispute resulted in a duel some years later.)
Exploration - orbiting the planet , many experiments and failures, look back to see what is sustainable, yet venture dangerous and experimental movements at the far end of the module tether… disconnect and there is no oxygen….
100+ years past the Founding.
Here is where we find the concept of our government being changed and that brings us to the Civil War and the 13th-14th-15th-16th-and 17th Amendments. Transformational change to the idea of “government”, we are becoming a representative democracy, which through civil upheaval has fundamentally changed the original intent of the “Republic” on which we were founded.
We see historic changes that shape the nation.
It has been argued that, had the original documents and the Founders intentions been applied after the Civil War the 14th, 16th, and 17th Amendments would have been unnecessary. That is exactly why we should revoke them and restore the power to the People and the States as stated in the 10th Amendment. All guarantees of civil liberties and due process are contained in the Constitution, it’s Articles and the Bill of Rights. It has been argued that indeed lawful ratification of the 14th is in question (compelled ratification by the Southern states in order to be re-admitted to the Union).
When the 14th gave the Congress supremacy then the power to tax in the 16th becomes constitutional, where it would not have been before. The 16th gives taxing power to Congress. And also allows them to direct tax earnings by their discretion without fair and equal requirement, which should be unconstitutional in its own right. The irony that makes it constitutional.......is itself. Without 14, 16 is unlawful and taxation should be restored to Article 1-Sec.8. 17 has proven to be no more of a preventative for power, greed, influence and corruption in modern days, in fact present examples far exceed any excess that existed in 1917. Return to the original intent of the Framers Article 1, Sec.3 clauses 1 and 2. In the modern day of technology and information transfer, it would be highly unlikely that any mis-conduct at the state level would go unnoticed or unattended.
Manage to keep the vehicle in orbit…but it’s been a bumpy and sometimes painful ride…
In-between period, we have:
18th amendment Prohibition - revoked by the 21st. It is the example we use to illustrate successful amendment process. It should be noted that the People wanted lawful purchase of alcohol and the government supported it because it gave them another very lucrative source of taxable revenue.
19th Amendment-Woman’s Suffrage
20th Congressional session terms and death or dis-qualification of a president-elect
22nd Presidential Tenure
23rd Electors for the District of Colombia
24th No voter disqualified on the basis of unpaid taxes
25th Presidential Succession
26th Voting age 18 yrs
27th Congressional Pay
….it is time to return home.
100+ years have passed to date. It is the 3rd water-shed moment in the 237 year history of the United State of America.
Sadly, We are a Nation of:
Diminished liberties of the People, a government that spends more than it takes in (fiscal cliff), borrows more than we can afford to re-pay (debt ceiling), is not responsive to the will of the People (Obamacare), regulates what it cannot pass and appoints political officers to oversee these departments and draft these regulations (not subject to Congressional review or approval). To date there are 37 czars appointed by the president and answerable only to him (party nor president - exempt for the promotion of this practice - plenty of blame to go around.) Such appointments were never intended in the original founding documents of this country.
It is the opinion of this group and of others who may share these views, that in order to restore our Republic and save Our Nation we must revoke the 14th, 16th, and 17th Amendments, thus restoring the power to the People and the States - the 10th Amendment. Such action maintains all the rights, privileges, and guarantees of the Constitution upon which we are Founded - to all citizens of this Nation. Our goal is an Article V. Amendment convention to propose the 28th Amendment which would do just that. Thank you for your time and attention to this matter. - L.Y.

OUR PROPOSAL
Propose a Twenty-eighth Amendment* 1. The fourteenth, the sixteenth, and the seventeenth articles of amendment to the Constitution of the United States are hereby repealed. 2. The articles shall be inoperative unless it shall have been ratified as an amendment to the Constitution by the conventions in several states, as provided in the Constitution, within seven years from the date of submission hereof, to the States by the Congress. So simple and it's done! *We seek to have the Item 1 above which is 20 words of the 28th amendment voted on in each of the 50 States' legislatures. * We seek to have all States legislative members educated to our SO SIMPLE AMENDMENT That RESTORE STATES' RIGHTS AND POWERS. *We believe that THE FEDERAL GOVERNMENT IS BROKEN AND IN DEBT - 125 years OF ELECTIONS HAVE NOT CHANGED the GROWTH OF POWERS IN WASHINGTON. *We believe that... WE THE PEOPLE... HAVE LOST CONFIDENCE IN GOVERNMENT - 77% OF THE POPULATION ACCORDING TO GALLOP (today) BELIEVE THAT DC- CANNOT - AND WILL NOT - CHANGE. |
